General Terms and conditions

These General Conditions and Conditions determine the rights and obligations of the parties in connection with the online sale of Products offered by the Seller.
These General Conditions of Conditions (hereinafter GTC) apply to all sales of products made through the Company’s Internet sites (which are an integral part of the Contract between the Buyer and the Seller). The Seller reserves the possibility of modifying the current GTC at any time by publishing a new version on its website. The GTC applicable then, are those in force on the date of payment (or the first payment in case of multiple payments of the command).

1.1 Contracts concluded on www.harbl.com are concluded exclusively in English and French. When ordering products, your contracting party is ColibriD SA.

1.2 By clicking on the button “Order with payment obligation”, you place a binding order for the items in your shopping cart. We will confirm the receipt of your order by e-mail immediately after receiving the full payment, the products will be shipped within 24 hours (or the next working day). With the receipt of the order confirmation and receipt of your payment, a standard sales contract comes into effect.

1.3 Please note that we are exceptionally not obliged to deliver the ordered goods if we have ordered them correctly on our side but have not received the delivery correctly or in time. We are not obliged to deliver the goods if we are not responsible for the lack of availability of the goods and we have informed you immediately. If the goods ordered are not available, we will immediately refund any payments already made or replace the order with another product of your choice, provided that this order corresponds at least to the price of the previous order.

1.4 We do not assume the risk of having to purchase ordered goods (procurement risk). This also applies to the ordering of goods that are only described according to their nature and characteristics (generic goods). We are only obliged to deliver goods from our stock and those ordered from our suppliers. When ordering articles from partners www.harbl.com, our stock includes the stock of these partners. We deliver your orders within Switzerland (CF 1.5 for shipments abroad). If the delivery time is stated in working days, this means all days from Monday to Friday, with the exception of Swiss public holidays.
1.5 Orders placed abroad are under the full responsibility of the buyer, whether in case of delivery problems or non-conformity with the laws in force. We recommend that you inform yourself about the laws in force in your country before placing an order on our website. In no case ColibriD SA can be held responsible in case of dispute.
Customs duties or other local taxes or import duties or state taxes may be payable in some cases. These rights and sums are not under the responsibility of the Seller. They shall be borne by the Buyer and are the Buyer’s responsibility (declarations, payment to the competent authorities, etc.). The Seller invites the buyer to inquire about these aspects with the corresponding local authorities.

2.1 The prices indicated in the offer at the time of the order apply. Prices shown are final. This means they are all taxes included. Within the limits of the code of consumption.

2.2 For the shipment of particularly bulky, heavy or valuable goods, different shipping taxes may apply.

6.1 The company ensures that the data of its customers are processed according to the legislation in force. All personal data will be considered confidential. The data recorded by the company is used for the registration and processing of orders and the administration of personal accounts of customers. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.

7.1 All clauses contained in these general terms and conditions of sale, as well as all the operations of purchase and sale referred to therein, will be subject to Swiss law.
